Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of WhyThisTrade (the "Service"), operated by Animus Labs ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Service.

3. Accounts

You are responsible for your account credentials and all activity under your account. Notify us promptly of any unauthorized use.

4. Not Financial Advice

The Service provides information, AI-generated analyses, and tools for educational and informational purposes only. Nothing on the Service constitutes financial, investment, legal, or tax advice. Markets are risky and you may lose money. You are solely responsible for your trading and investment decisions and should consult a qualified professional before acting.

5. Subscriptions and Billing

Paid plans are billed through Stripe on a recurring basis until cancelled. Fees are non-refundable except where required by law. You can cancel at any time; access continues through the end of the current billing period.

6. Acceptable Use

  • Do not reverse engineer, scrape, or misuse the Service.
  • Do not resell, sublicense, or share access to paid features.
  • Do not use the Service to violate laws or infringe others' rights.
  • Do not abuse AI features (e.g. automated mass requests, attempts to extract prompts).

7. Intellectual Property

The Service, including its software, design, and content, is owned by Animus Labs and its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Third-Party Data

Market data, news, and other third-party content are provided by third parties and may be delayed, inaccurate, or incomplete. We make no warranties about such content.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMUS LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any other reason. You may stop using the Service at any time.

12. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Animus Labs is established, without regard to its conflict-of-laws principles.
